Responsible Individual & Provider Governance in Wales
Independent review of provider oversight, Responsible Individual responsibilities and governance arrangements for regulated social care services in Wales.
The Welsh regulatory framework places distinct responsibilities on service providers, Responsible Individuals and managers.
Oxara supports organisations requiring an independent view of whether those responsibilities are clearly allocated, exercised in practice and supported by credible evidence.
Provider and Responsible Individual accountability
The Regulation and Inspection of Social Care (Wales) Act 2016 and regulations made under it place responsibilities on service providers and Responsible Individuals.
The Responsible Individual has a defined oversight role, with duties focused on the effective management and oversight of the service and continuous improvement. Day-to-day management remains the responsibility of the manager unless the Responsible Individual also holds that role in circumstances permitted by the regulatory framework.
Oxara can review whether governance arrangements reflect those distinct responsibilities in practice.
Governance that operates in practice
Effective governance requires more than named roles and written policies.
Oxara examines how provider oversight, Responsible Individual scrutiny and management arrangements interact, including whether information moves effectively between operational management and those accountable for oversight.
The purpose is to identify gaps between the governance structure described by the organisation and the governance demonstrated by its evidence.
Responsible Individual oversight
Responsible Individuals have specific monitoring and oversight duties under the regulations applying to regulated services.
For services covered by the relevant requirements, CIW guidance confirms that RI visits must take place at least once every three months and that evidence of those visits and their outcomes must be recorded. RI oversight also contributes to the organisation’s review of the quality of care and support provided.
Oxara can review whether those arrangements demonstrate meaningful scrutiny, follow-through and organisational learning rather than simply completion of prescribed activity.
Evidence of oversight and assurance
Boards, providers and Responsible Individuals need reliable evidence on which to base assurance.
Oxara can examine whether governance information provides a coherent picture of service quality, operational risk, management performance and required improvement.
This may include the relationship between RI visits, quality reviews, complaints, incidents, workforce information, audit findings and actions arising from oversight activity.
Where governance concerns have been identified
Where CIW findings raise concerns about leadership, management or provider oversight, Oxara can independently review the evidence and the organisation’s proposed response.
The purpose is to determine whether the underlying governance weakness has been identified and whether proposed actions are capable of producing demonstrable improvement.
For wider post-inspection or regulatory-response work, Oxara also provides dedicated Regulatory Response & Improvement Support in Wales.
Governance in context
The precise duties applying to a provider or Responsible Individual depend on the type of regulated service and the regulations that apply to it.
Oxara therefore approaches governance review against the organisation’s actual service model, regulatory framework and allocation of responsibilities rather than applying a generic governance template.
