When a Registered Manager is required
A Registered Manager is required where a person manages the regulated activity on behalf of an organisation or partnership. An individual provider may also require a Registered Manager where that individual does not personally manage the regulated activity.
The Registered Manager is registered with CQC for specified regulated activities and locations and shares responsibility with the provider for meeting the requirements that apply to the service.

CQC must be satisfied that the proposed manager is fit to manage the service
Regulation 7 of the Health and Social Care Act 2008 (Regulated Activities) Regulations 2014 requires the Registered Manager to be of good character and to have the qualifications, competence, skills and experience necessary to manage the regulated activity.
The evidence should be relevant to the service for which the person is applying. Experience that is suitable for one type of service may not demonstrate competence for another service with different risks, service-user needs or clinical responsibilities.

The application and assessment must support the proposed scope of responsibility
The Registered Manager application requires information about the applicant, employment history, qualifications, experience and the service they intend to manage. CQC also requires the relevant DBS evidence and may request further information during assessment.
CQC may assess the applicant’s knowledge of the service and the regulatory requirements that apply to it. The assessment can include questions about safeguarding, medicines, staffing, complaints, mental capacity, governance and other areas relevant to the regulated activities.

The manager’s registration must match the activities and locations they will manage
A Registered Manager may be registered for more than one regulated activity and, where appropriate, more than one location. The proposed scope should reflect the responsibilities the person can manage effectively.
Where the role covers multiple locations or services, the provider should be able to demonstrate how the manager will maintain oversight, receive information, make decisions and escalate concerns.

The Nominated Individual represents an organisational provider
Where the provider is an organisation, Regulation 6 requires it to nominate an individual who is employed as a director, manager or secretary and who is responsible for supervising the management of the regulated activity.
The Nominated Individual should have sufficient seniority and authority to represent the organisation in relation to the regulated activity. The provider must take reasonable steps to ensure that the individual is suitable for the role.
The Nominated Individual is not registered as the Registered Manager. The two roles have different functions: the Registered Manager is responsible for day-to-day management of the regulated activity, while the Nominated Individual supervises its management on behalf of the organisation.

The same person may hold both roles in some organisations, but the provider should consider whether this gives sufficient separation between day-to-day management and senior organisational oversight.
CQC may need to escalate a matter beyond the Registered Manager to a more senior representative of the provider. The governance structure should therefore make clear who supervises management, who receives escalated concerns and who can act on behalf of the organisation.

Changes to Registered Managers and Nominated Individuals require the correct process
A new Registered Manager must apply for registration with CQC before the change is treated as a completed registration matter. Internal appointment to the post does not by itself register the person.
Where an organisation changes its Nominated Individual, the provider must notify CQC. Other changes to directors, secretaries or similar officers may also require notification.

The management arrangement must be supported by the provider’s governance system
The Registered Manager and Nominated Individual should understand the reporting, assurance and escalation arrangements that apply to the service. This includes how the provider manages safeguarding, incidents, medicines, staffing, complaints, risk and quality assurance where these are relevant to the regulated activities.
CQC may test whether senior individuals understand these arrangements and their own responsibilities within them.
