Responding to regulatory concerns

Regulatory concerns require a clear understanding of the findings, the applicable requirements and the evidence available to the organisation.

Oxara can independently review RQIA correspondence, inspection findings, identified deficiencies and the organisation’s proposed response.

The purpose is to distinguish the underlying issues from symptoms, identify where the organisation’s evidence is incomplete and assess whether proposed actions address the concerns identified.

From findings to improvement

A regulatory response should do more than record that an action has been completed.

Oxara examines whether improvement activity is connected to the original concern, whether responsibilities are clear and whether the organisation can demonstrate that changes have been implemented in practice.

This may include review of governance arrangements, management oversight, operational controls, quality assurance, workforce evidence and other material relevant to the findings.

Evidence of sustainable improvement

Improvement needs to be supported by evidence that changes have been implemented and are operating in practice.

Oxara can review whether the available evidence supports that position, including whether actions have been followed through, monitored and tested over time.

The focus is on whether the organisation can demonstrate a credible relationship between the concern identified, the action taken and the resulting change in practice.

Governance and accountability

Regulatory concerns can expose weaknesses in governance as well as operational delivery.

Oxara can examine whether oversight arrangements are capable of identifying risk, escalating concerns, tracking actions and providing meaningful assurance to those accountable for the service.

Where relevant, this may include consideration of management arrangements, provider oversight and the systems used to maintain regulatory assurance.

Preparing for further regulatory scrutiny

Where RQIA is expected to revisit the service, seek further evidence or undertake additional regulatory activity, Oxara can independently assess the strength of the organisation’s current regulatory and evidential position.

This may include testing the quality of supporting evidence, whether actions have been completed as described and whether remaining weaknesses are understood and appropriately managed.

Oxara does not seek to predict regulatory outcomes. The purpose is to help the organisation understand the strength of its current evidence before further scrutiny.

Wider operational recovery

Some regulatory concerns are symptoms of wider operational weakness.

Where appropriate, Oxara can consider whether issues identified are connected to management capacity, workforce instability, ineffective governance, weak quality systems or other operational factors.

This allows the response to address the causes of failure rather than treating regulatory findings in isolation.

Regulatory response in the Northern Ireland context

The appropriate response depends on the nature of the findings, the applicable regulatory requirements, the service concerned and the level of risk.

The regulatory framework in Northern Ireland includes the Health and Personal Social Services (Quality, Improvement and Regulation) (Northern Ireland) Order 2003, together with service-specific regulations and standards applicable to the organisation concerned.
